Apple iPhone Lawsuit
The early legal negotiations between Apple Computer and Cisco over the new product named iPhone started back in August, 2001 might turn into an ugly legal court battle if they don't settle the issue out of court, because both of the technology companies assert the full rights to use the Trademark iPhone.
Apple CEO Steve Jobs recently introduced what Apple Computer is calling iPhone cell phone,Apple Computer Incporporated states that this is the most important new product launch since the Apple iPod was released in 2001. Steve Jobs, calling the multi-functional device ( it combines the apple iPod, cell phone capabilities, one of the most exciting mobile handset products he's ever been a part of. Steve Jobs was quoted as saying the iPhone would "reinvent the telephone as we know it"
The day after Apple Computer announced the iPhone Mobile Phone Cisco company filed a court lawsuit against the Apple Company for U.S. trademark infringement on the Cingular iPhone name, because it received the iPhone trademark over 7 years ago when Cisco acquired the company Infogear. Infogear, which had originally filedr the trademark iPhone in 1996, became a part of Cisco Company's Discount Linksys Router division. That Linksys Routers division originally introduced a new family of tech products called iPhones early in the year 2006 and thjen expanded it again in December, 2006.

Apple Computer was not impressed about the legal action from Cisco. "We think the Cisco lawsuit is just silly, because a number of other voice over IP companies are already using the name trade name called iPhone," Nate Kerri, Apple Computer director of public relations services, told a reporter at World Press International. "We contend that their United States trademark is tenuous at best, because we see it as a generic term. We are also the first company to name a cell phone as the iPhone. If Cisco wants to challenge us on it, we're confident we'll prevail." Apple has no comment on what the next legal move will be, or whether the discussions are going to continue with Cisco, Kerris said. Teledex, Nex-Tech and Etronicsland all are among the companies currently marketing products called iPhone on the Internet at this time.
Apple Computer iPhone Trademark Lawsuit
A recent search of trademark and patent office Web sites revealed that Apple already has the iPhone trademarked in the United Kingdom, Singapore and Australia, while other filings are pending in Canada, the European Union, New Zealand and Hong Kong. Cisco said in its complaint that Apple had first approached the company about acquiring the rights to the iPhone trademark in 2001. Over the years, Apple continued to make requests for the rights, including several attempts in 2006, Cisco said.
"We have owned the iPhone trademark name for many years. Apple ipods has acknowledged this by coming to us many times over the last 5 years to try and acquire the right to use the trademark name," said Cisco Company spokesperson Jon Nohn. "That is a clear acknowledgement that we own the trademark name iphone lawsuit. The legal actions we took are not about money or the product, but about an obligation to protect our trademark nams in the face of Apple's gross and willful violation of the trademark laws". In the days leading up to the January ninth 2007 launch of the new Apple iPhone telephone, Cisco and Apple iphone had engaged in extensive discussions over an agreement to "share" the trademark, according to Nohn. But Apple iphone lawsuit launched the iPhone lawsuit on January ninth, 2007 without signing the agreement, he added. "We sent over the final terms to them recently, and we didn't get the approved agreement back from their lawyers. But they launched the Appleiphone anyway. We believed that meant they agreed to the terms and would send over a signed agreement to us. That didn't happen today. By that action, we believe they decided to forgo the agreement and used our trademark illegally.
